Title VII and Title IX

“How is this different from Title VII and Title IX?”

  • A constitutional amendment is more enduring than legislation.
    • Title VII is a federal law that prohibits employers from discriminating based on sex, race, color, national origin, or religion.
    • Title IX is a federal law that requires federally-funded schools to provide students with equal opportunities regardless of sex.
    • The 28th Amendment (Equal Rights) is a constitutional amendment and prohibits sex discrimination by the government.
  • Unlike Title VII and Title IX, which is federal legislation that can be repealed or replaced, removing gender equality from the Constitution would require another constitutional amendment.
